The Original Lawsuit was filed on 18th May 2017 and include many misleading allegations, that there were no Firebreaks in the building, No Sprinkler in the Garbage Chute and other important items including Catch basins filled with debris, missing door closure Mechanisms and even missing Elevator Licence. 130, or so, petty items lifted verbatim from the 2015 Performance Audit. This itself was 4 years after the NSCC72 Condominium was registered and occupied by residents. After 4 years of wear & Tear many items were simple maintenance issues. In any event most, if not all, alleged deficiencies did not exist in May 2017.

BUT NOW IN 2025 THERE ARE MORE DEFIENCIES THAT ARE TOTALLY STATUTE BARRED UNDER THE LAWS OF CANADA!

According to the Lawsuit in 2017 Mansions on George at 323 George Street, Cobourg (NSCC72) was “not fit for Human Habitation.”

But it gets worse………see latest EXPERTS report below. Apparently repairs to Mansions on George (NSCC72) are now expected to cost $11,763,546.00. Yes, that right, ELEVEN MILLION SEVEN HUNDRED SIXTY THREE THOUSAND FIVE HUNDRED AND FORTY SIX DOLLARS plus presumably 13% HST of $1,52,260.98 totaling $13,292,806.98.
Repairs on existing residential Condominiums are not exempt from HST.

According to EXPERT calculations UNIT COST AVERAGES $336,101. 31 (+ HST of $43,693.17 each ) totaling $ 379,794.48 for all of the 35 Condominiums in Mansions on George. That is going to be a huge Special Assessment for the owners/residents to swallow and it will probably be higher for larger units that the owners the Condo board purports to represent.

THIRTEEN MILLION TWO HUNDRED and NINETY TWO THOUSAND EIGHT HUNDRED and SIX DOLLARS. as calculated by NSCC72 Architect and Engineering experts who must be right .

Just an incredible situation that has developed for over 15 years seemingly due to lack of maintenance since Mansions on George was registered as NSCC72 in 2011.

This is, of course, on top of the hundreds of thousands of dollars of waste on Experts & Lawyers etc. since the NSCC72 Statute Barred lawsuit was launched in May 2017. This $13,292,806.98 should have been spent on repairs, if necessary, over the last FIFTEEN YEARS!
